EuBinder Terms of Service
Version 1.2 of 13 October 2026 · ID terms-1.2-2026-10-13

1. Parties and scope

1.1 These Terms are a contract between PPFTEC S.R.L. (Trade Register no. J2026052999008, CUI RO55537142, registered office: Str. Patriarh Iustinian Marina 17-19B, bl. DC12, mansardă, ap. 25, Râmnicu Vâlcea, România; support@ppftec.com) ("we") and the business that installs the EuBinder app in its Shopify store ("you").

1.2 EuBinder is offered only to businesses acting for their trade or profession. By installing the app you confirm that you are not a consumer. Consumer-protection rules for consumer contracts therefore do not apply.

1.3 Shopify is not a party to these Terms. Your use of Shopify is governed by your agreement with Shopify.

1.4 Our Data Processing Agreement (DPA) at https://eubinder.ppftec.com/dpa forms part of these Terms.

2. The service, and what it is not

2.1 EuBinder is an information and document-preparation tool. It shows EU and national obligations that may apply to your store, with the official source, date and a confidence level for each rule. It helps you prepare documents (for example GPSR product-page details, PPWR declarations and technical files, accessibility statements), track dates you enter and share documents through the document center.

2.2 EuBinder is information, not legal, tax or customs advice. We do not certify compliance, and we do not act as your EU responsible person, authorised representative, importer, compliance scheme or adviser. Rules can change and can be interpreted differently by authorities and courts; we show the rule version and source date so you can check them.

2.3 You decide and you sign. You review every document before using it. Declarations of conformity are drawn up under your sole responsibility as manufacturer or other economic operator.

2.4 Features labelled "beta" or "preview" may change or be withdrawn.

3. Your responsibilities

3.1 Give accurate and complete information, and keep it up to date.

3.2 Review the output before use. Keep the records the law requires of you. For example, if you are the PPWR manufacturer or importer of your packaging, you must keep its EU declaration of conformity (and, as manufacturer, its technical documentation) for 5 years, or 10 years for reusable packaging (PPWR Art. 15(3), 18(7)). Export your documents before you uninstall (§10.4).

3.3 Upload and share only content you are allowed to share, that contains no unlawful content and no special categories of personal data. Do not upload customer or order data.

3.4 Have a legal basis for any personal data you give us, and inform the people concerned (see the DPA).

3.5 Keep your Shopify account secure. Do not attempt to access other merchants' data, overload the service or reverse-engineer it.

4. Fees

4.1 Plans and prices are those shown in the Shopify App Store listing and in the app at the time you subscribe. They are charged only through Shopify Billing, on Shopify's billing terms.

4.2 The Free plan costs nothing. A paid plan is charged only after you approve it in Shopify.

4.3 Prices may change with at least 30 days' notice in the app. A change applies from your next billing period after the notice. If you do not agree, you can uninstall before then.

5. Intellectual property and licences

5.1 We own the app, its software and our rules data. We grant you a non-exclusive, non-transferable right to use the app for your store during the subscription.

5.2 You keep all rights in the content you enter or upload and in the documents generated from your data. You grant us a licence to host, process and display that content only to provide the service to you, including showing it to the people you share it with.

6. Data protection

6.1 For the business data and documents you put into the app, you are the controller and we are your processor under the DPA.

6.2 For the data we need to run our business (account, billing, support, security), we are the controller; see the app privacy policy at https://eubinder.ppftec.com/app-privacy.

7. Document center and illegal content (Digital Services Act)

7.1 The document center stores documents you upload and serves them to people who have your share link. For this feature we act as a hosting service provider under Regulation (EU) 2022/2065 (DSA).

7.2 Content restrictions. You may not upload or share content that is illegal, infringes others' rights, contains malware or contains personal data you are not allowed to share. We do not monitor content in general. We act on notices and on our own findings of clearly illegal content.

7.3 Notice and action. Anyone can report content they consider illegal by e-mail to support@ppftec.com, with the subject "Illegal content report". A notice should give the share link or document, explain why the content is illegal, give the sender's name and e-mail (unless it concerns child sexual abuse material) and include a statement that the notice is accurate and complete to the sender's knowledge. We confirm receipt, decide diligently and tell the sender our decision.

7.4 Statement of reasons. If we remove or disable access to your content, we tell you why, which rule or law applies and how you can contest the decision (by replying to support@ppftec.com, or out of court or in court).

7.5 Points of contact. Authorities: support@ppftec.com (languages: English, Romanian). Users and other recipients: support@ppftec.com. These channels are also the single points of contact under DSA Art. 11–12.

8. Switching and export (EU Data Act)

8.1 EuBinder is a data processing service under Regulation (EU) 2023/2854 (Data Act). You can export your data at any time, on every plan, from the app (Settings, "Export all"). The export is one ZIP archive. It contains the following categories of data and digital assets of your shop:
(a) your business details: countries, size, role, legal name and address, notification e-mail, shop domain and install date, plan, and the record of the Terms and DPA versions you accepted;
(b) the product cache (product reference, title, handle, URL, category);
(c) checklist evaluations (the newest 20 that the service keeps) and your progress, notes and reasons;
(d) GPSR operators, store defaults and per-product safety information;
(e) packaging types with their components, suppliers and product links;
(f) the evidence files you uploaded, byte for byte, with their metadata;
(g) every generated document of every status, as PDF, with the input snapshot that reproduces it (JSON) and, for accessibility statements, the HTML version, together with numbers, versions and checksums;
(h) EPR registrations, deadlines and evidence links;
(i) accessibility scans (the newest 5 that the service keeps), remediation tasks and your accessibility statement answers;
(j) the share links you created (without the link secret);
(k) the activity log of your shop.
Data are in JSON files (UTF-8), a structured, commonly used and machine-readable format. Documents are in PDF (and HTML), and evidence files keep their original format. A manifest lists every file with its SHA-256 checksum, and a README file in the archive describes each file, its structure and its format.

If your data is too large for one archive, contact support@ppftec.com. While EuBinder remains installed, the service can prepare several secure downloads after you confirm the request in the app. Use the same Shopify staff account to view and download the prepared parts. Temporary support copies expire seven days after preparation starts; the deadline is shown in the app. This deadline does not shorten the retrieval period in section 8.4: while the app remains installed, contact support if you need the data prepared again during that period. Each archive part must fit below 2 GiB, including its metadata; if an indivisible file or required part cannot fit, preparation cannot complete through this flow and you must contact support about that specific request. Uninstalling ends access as described in section 8.6.

8.1a The export does not contain: (1) security credentials: Shopify access tokens and sessions, share-link secrets and export download tickets; (2) records of how the service itself runs: background jobs, Shopify webhook and privacy-request records, deletion records, support-export request confirmations, preparation receipts and multipart cleanup journals, and the installation record (access scopes granted, API version); (3) counters: accessibility scans used per month and the document-number counter (the numbers already used are in the export). This list is exhaustive. These items are specific to the internal functioning of the service, and exporting the credentials would put the security of the service and of your shop at risk. Their exclusion does not stop or delay switching: everything you entered or uploaded and every document generated for you is in the export. If you need a record from (2) or (3) for your switch, ask us and we will provide it, unless that would breach security or our trade secrets.

8.2 Switching. To switch to another provider or to your own systems, or to have your data erased, give notice in the app or by e-mail to support@ppftec.com (subject "Switching request") at any time. Tell us which of these you choose; if you switch to another provider, give us the details we need about it.

  • Notice period: at most 2 months from your notice. You can ask for a shorter one.
  • Transition period: at most 30 calendar days after the notice period. During it these Terms continue to apply and we: help you and the third parties you authorise with the switch, including your exit plan, and give you all relevant information; keep the service running with due care; tell you about known risks to its continuity; and keep your data secure, including while it is transferred.
  • If 30 days are technically unfeasible, we tell you within 14 working days of your notice, explain why, and propose an alternative transition period of at most 7 months, during which the service continues.
  • You can extend the transition period once, for the period you consider appropriate, by telling us before it ends.
  • Keep the app installed during the notice, transition and retrieval periods. Uninstalling ends them (§8.6).

8.3 Exporting and switching are free of charge.

8.4 Retrieval period. After the transition period ends, you can still retrieve your data through "Export all" for at least 30 calendar days (retrieval period). The retrieval period needs the app to stay installed: if you uninstall, it ends (§8.6). We keep your data secure during this period.

8.5 End of the contract and erasure. The contract ends, and we tell you by e-mail, when the switch has been completed successfully or, if you chose erasure, at the end of the notice period. It also ends when you uninstall EuBinder (§8.6, §10.1). After the retrieval period, or a later date we agree with you, we fully erase all exportable data and digital assets of your shop, as set out in §10.4 and the DPA.

8.6 Uninstalling, also during a switch. Uninstalling EuBinder ends these Terms (§10.1). If a switching request is open, uninstalling also ends the notice period, the transition period and the retrieval period on that day. In every case we delete your data as set out in §10.4; we do not keep it after uninstall and cannot restore it or send it to you. Before you uninstall, run "Export all" and save the archive. If you are switching and still need your data, keep the app installed until you have downloaded it.

9. Liability

9.1 We provide the app with reasonable skill and care. Apart from that, and to the extent the law allows, the app is provided "as is". We do not guarantee that the rules data is complete, current or correct for your situation, or that a document will be accepted by an authority.

9.2 Our total liability under or in connection with these Terms, for all claims together, is limited to the greater of (a) the fees you paid us in the 12 months before the event that caused the claim and (b) EUR 100.

9.3 We are not liable for indirect or consequential loss, lost profit, lost revenue, lost data you could have exported, or fines and penalties imposed on you, except where the law does not allow this to be excluded.

9.4 Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for intent or gross negligence (Romanian Civil Code art. 1355) and for death or personal injury.

9.5 You are responsible for your use of the documents and for the content you upload. You will hold us harmless from third-party claims arising from content you upload or share in breach of §3.3 or §7.2.

10. Term, suspension, termination and uninstall

10.1 These Terms apply from install until you uninstall or we end the service.

10.2 We may suspend access, after notice where possible, if you breach §3 or §7 or if needed to protect the service or other users.

10.3 We may end the service for everyone with 60 days' notice in the app and by e-mail; you keep the export (§8) during that time.

10.4 Uninstall. If you uninstall EuBinder, Shopify tells us 48 hours later. We then delete your data within 30 days, also if a switching request is open (§8.6); backup copies expire 30 days after that. Export your documents first (§3.2). Clauses that by nature survive (§5.2 licence for deletion, §9, §11) survive.

11. General

11.1 Referrals. Where the app points to third-party services (for example authorised representatives or compliance schemes), these are labelled as third-party. We do not act for them and receive no payment for referrals.

11.2 Changes to these Terms. We will tell you in the app at least 30 days before a change takes effect. If you continue to use the app after that date, the new Terms apply. If you do not agree, uninstall before then. Changes required by law can apply sooner.

11.3 Force majeure. Neither party is liable for delays caused by events outside its reasonable control.

11.4 Governing law and courts. Romanian law applies. The courts competent for PPFTEC's registered office have jurisdiction, unless mandatory law provides otherwise.

11.5 Language. These Terms are made in English. Translations are for convenience only.

11.6 Contact. support@ppftec.com; data protection: privacy@ppftec.com.

11.7 Entire agreement. These Terms, the DPA and the app privacy policy are the whole agreement about EuBinder. If a clause is invalid, the rest remains valid.
